General Terms and Conditions (GTC)
Whisky Golf Lounge

I. Scope of Application
These General Terms and Conditions apply to the use of the indoor golf facility and all associated services of the Whisky Golf Lounge (in particular golf simulators, lounge area, events, and additional services).

In addition to these GTC, the respective current house rules of the Whisky Golf Lounge apply. The house rules form an integral part of these GTC and must be observed by all guests. They apply to all indoor and outdoor areas of the facility, including parking and ancillary areas.

These GTC become effective upon entering the premises or upon booking services.

II. Services and Conclusion of Contract
The contract is concluded by booking on site, online, or by written confirmation (e.g. by email) between the customer and the operator. In the case of online bookings, the contract is deemed concluded upon receipt of the booking confirmation.

III. Opening and Playing Times
The current opening hours are posted on the operator’s premises and published on the website.

The regular playing time per booking unit is at least 60 minutes. The display of the simulator is decisive for the start and end of the playing time.

After expiry of the booked playing time, the simulator must be vacated without request. Any additional commenced time unit will be charged according to the current price list.

IV. Booking
Bookings are only possible within the scope of available capacities. There is no entitlement to the availability of specific time slots.

Each confirmed booking constitutes a time-limited rental agreement for the use of a golf simulator.

If the customer arrives more than 15 minutes late for the booked appointment, the operator reserves the right to shorten the booked period. In this case, there is no entitlement to a refund.

V. Cancellation / No-Show
A booking may be cancelled free of charge up to 12 hours before the start of the booking.

In the event of cancellations less than 12 hours before the start or in the event of no-show, the full booking price is due. The customer may prove that no damage or a lesser damage has occurred.

VI. Prices and Payment
The booking price is due after use.

If the customer exceeds the booked period, the additionally commenced period must be paid according to the current price list.

VII. Vouchers
Gift vouchers can be redeemed for bookings and services of the Whisky Golf Lounge. If the voucher value is insufficient, the difference must be paid.

Vouchers and remaining credit are subject to the statutory limitation period. Cash payment or interest on the credit is excluded.

Vouchers are transferable. The operator is not liable for unauthorized use by third parties unless there is intent or gross negligence.

VIII. Liability
Use of the facility is at the guest’s own risk.

The operator is liable without limitation in cases of intent and gross negligence as well as for injury to life, body, or health.

In cases of simple negligence, the operator is only liable for breaches of essential contractual obligations and limited to foreseeable, typical damage.

The operator is not liable, to the extent permitted by law, for damage caused by improper use, failure to follow instructions, or caused by other guests.

The operator is not liable, to the extent permitted by law, for accidents caused by the guest’s own fault.

IX. Property Damage
The facility, simulators, and all inventory must be handled with care and used as intended. The customer is liable for all damage caused by themselves or members of their group, unless it is due to normal wear and tear or material defects.

X. Loss of Items / Vehicles
The operator is not liable for the loss or damage of clothing, valuables, or other items brought along, unless there is intent or gross negligence.

No liability is assumed for damage to or theft from vehicles parked on the premises and their contents. There is no obligation to safeguard items left behind.

XI. Violations and House Ban
In the event of violations of these GTC or the house rules, the operator is entitled to exclude guests from further use of the facility or to impose a ban from the premises.

The obligation to pay for already booked services remains unaffected. Further claims for damages remain reserved.

XII. Dispute Resolution
The operator does not participate in dispute resolution proceedings before a consumer arbitration board.

XIII. Data Protection
The currently applicable data protection provisions apply and can be accessed on the operator’s website.

XIV. Applicable Law / Place of Jurisdiction
German law shall apply exclusively. The place of jurisdiction is, insofar as legally permissible, the registered office of the operator.

XV. Severability Clause
Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
